BUYING FROM JAPWESTMOD CAUTION!!!!!

Hi , all . I have a story to tell a very distressing story and I am looking for help or at least make everyone aware

I purchased a car form Japwest Mods at the start of December for £9199.99 which involved this in the contract:

involved All importation duties & fees, transport to our store £150 Service with the Oils, filters and spark plugs swapped & get MOT ready £250, UK Road registration inc 1 years MOT will be paid by JapWest Mods LTD £300 and are included in the final price with ML discount.

Initially, I paid £1000 deposit, but he then asked for the full payment. Unfortunately, I was too naïve and accepted to pay the full amount despite this clause in his contract

The total amount outstanding for the vehicle excluding deposit is £9199.99 to be paid upon receipt of the vehicle in full and final settlement for the vehicle.

It was planned to arrive 6-8 weeks later but ended up arriving 6 months later. Nevertheless, I persevered and kept my patient, unfortunately this was not the end of the problems. He that ask for an extra £400 for work to be done to pass MOT which is in violation of said contract clause above

Hi Tan

As per our telephone conversation earlier, re attached is a list of work needed to get the silvia up to UK MOT specification.

With the age and nurture of these cars, it’s extremely common to replace and amend serviceable parts like clutches, braking, pipes, belts etc

In regards to the list below most jobs are covered (paid for) as we spoke about when you purchased the car, with only a few items needed to be done this end. which is common for the age, most used cars will need items replacing every few years.

To do list:

- tyres

- 2 x wheel hubs

- rear arch pocket slightly worn and will need a weld

- exhaust manifold has air leak

- intercooler exchanged

- replace any worn pipes

- replace any cable ties with metal brackets

- full service

- exhaust leak repaired

- re con the battery

- check all fluids and top up if needed

- replace all bulbs

- general tidying of the car if it needs it

Following this , I had a telephone conversation to discuss how this violates the clause as I paid £250 extra for the car to be MOT ready , he disagree and so I asked for a refund on JUN 11th as I was not happy to pay any more money , This follows japwest mods return policy as I have not even taken receipt of the car

Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a legal right to cancel the contract between you and us within 14 days of delivery without giving a reason unless the product is a custom order/ bespoke order.

So all in all after lots of lies on subsequent emails this is the last email. He tells me the money is ready and I will get my refund but he could not provide me with a proof of refund . I contact my bank who told me there is no money on the way and there is nothing they can do about it

Hi Tan

Were getting to the bottom of this now and hope to get you the refund in the next day or 2.

Something to do with security bank checks.

Best Regards

I have emailed him again and again , sent him messeges wia whatsapp , facebook messenger , called his office multiple times for days only to hear he is not available all of the sudden .

Right now with thousands of pounds missing I am in absolute desperation and need help . Any advice will be appreciated

Always thought they were dodgy with the suspicious way they offered cars/products they didn't actually have with a fair bit of markup. Sorry to hear about the mess its been for you, hopefully gets sorted and hopefully someone in the UK steps up to be a decent reputable importer.

So surprised this guy is still in business, he fucks over everyone and lies about the condition of parts all the time.

I think buying things off them that aren't in the UK is when the problem starts. I bought my Work wheels & a mate also bought his Works off them and they were spot on. These horror stories seem to be when things aren't in UK stock to begin with.

Hope it gets sorted and others realise its better to wait until the car is on UK soil before handing over money, or use a different importer to get the exact car you've seen on an auction site.

Happened to me aswell bought a chaser off them "Japwestmods" in 2017 Dec and nothing turned up I waited till April to find out there's nothing coming for me I had given the full amount aswell, But I did get a full refund and a apology but was car less which was really annoying. Did waste a lot of my time hardly answered my calls or returned them. Be careful people!!

If you want his attention why not post on his Instagram page. He seems to have time to update that all the time. Comment on his posts. At worst it’ll disrupt him to the point where he has to make contact.

hey peeps , i appretiate the sharing . Just an update I finally did get into contact with him earlier this week , he tells me that he will get everything sorted by Friday . However apparently there has been yet another delay , so we into next week and hopefully i get my refund then .

Honestly these guys are the worst, communication is great until they have your money then they stop answering calls, I had his mobile, her mobile, their office phone I couldn't get any answer from them for weeks. As soon as you slate them on social media though they suddenly start remembering how phones work and usually call you.

I'd try and get your money back asap because they will just delay and delay then try and weasel out of it.

Good luck!

Hi tommy59

Thank you for your reply , could u elaborate what happened on your part and did you eventually get a refund ??

I'm not going to type it all out again but it's at the top of page 9 on my build thread.
Long story short ordered a RB25 box from Japan and got sent an RB20 box, lots of false promises about an RB25 box arriving to swap it but got the difference between the two refunded after a few months.

Seriously dude, why should a refund take longer than 24 hours. Have they not heard of faster payments. Last time I got messed around over a refund by a supposedly reputable firm, I went on their Instagram. Replied to the most recent 6 posts with a shortened version of the full story. Had my money back within 3 hours. They’ve fucked you about. You owe them nothing

I bought a pair of recaros through Jap West Mods and can agree the wait times, contacting him and eventually picking up the seats took a lot of time, luckily I got a fantastic pair of seats and I'm really happy with them but I wont be going back to him for anything else after having to wait months and then not necessarily getting what I was sent pictures of.

I now use MLimports for everything, much more honest and upfront and offers good advice about what you are buying too.

FCUH , funny story . I decided fuck it i am going to be uncivil and wrote :

i am still awaiting the refund you said i will get my refund by Tuesday of this week . This is after multiple delays over the last couple of weeks , and yet i have not receive anything . You have also chosen to ignore all my phone calls over the last three days . i dont understand the kind of buisness you run , it has been full of lies and let down . If you think i will stand down and forget my £9199.99 you are wrong . I recomend you take this seriously and sort the problem you have with my once and for all . No more lies to more let down . No more money coming in from japan clearning 3 banks and all that nonsense . I want my refund and i want my refund now !!!

all over their instagram and facebook . I received a phone call within 10 seconds. Unfortunately no refunds just yet but he says i will get it by tomorrow lunch time . We will see what happens tomorrow. But it was funny how fast it happened.

also monkey London got involve and posted car for sale. It makes me believe there was a delay in the funds' movement after all its £9199 . Hopefully, all goes well tomorrow and receive the refund.

I think the whole thing is such a shame, cause i heard the actual cars they sell after a deal is completed Isnt too bad. I haven't heard of a bad story after the customer picks up the car. But the nonsense before has been discussed multiple times.

Emard , Thanks i will look them up .

I personally now use GarageSR. Its a one-man show pretty much up in Aberdeen . But the guy is a really honest guy who help me loads . Once this is all over i can tell you guys more about it. There are many surprises.

This is the biggest problem I'm seeing at the moment with shady traders, it's not just businesses its individuals too. I'm sorry to hear the issues you have faced with this specific trader, however the easiest way to clear things up is to use the online Money Claim services, the last time I used it the cost was £65 but you claim that back from the trader:

https://www.moneyclaim.gov.uk/web/mcol/welcome

It's a very straight forward process, and as a result you can claim all of your money, costs and interest @ 8% for the duration they have had your payment. You have pointed out the clauses in their contract and you have a clear cut claim. I'd submit the forms on this jerk and be done with it. Let the courts deal with him and have the dealing be entered into public records. You can also submit a notification on Rogue traders and Watchdog, I'm sure there are plenty of other people that have had the same issues as you.

The car community need to stick together when this kind of thing happens, and help each other out. Because otherwise shady traders get away with it.

@MrSatoshi that is some beautiful information . i think it should be pinned my admin somewhere to help people that are in my position . maybe under a how to buy a jap car and how to deal with problems . I was on the verge on having to pay 20% to a lawyer with no possibility of getting the interests and all that .

So an update , after a massive 4 weeks of cock and balls i got the money back minus a small restocking fee of £350 . which is 3.8% not too bad .I also received a long phone call with Maz apologizing and explaining that this is their first large refund and that he is a genuine company that did not have a bad agenda . He mention that he found it difficult to keep track with all the phone calls . i suppose his buisness plan which makes him reception , sales , customer service, accounts ,manager and ceo would explain all his difficulties . Either ways all is done and the case is finally over .

Why the restocking fee. Contract wasn’t delivered upon. Should be a full refund especially given how long they had your money

Seriously that’s a piss take. Ask for the whole lot back otherwise go down the moneyclaim route. Providing you put together a half decent case, you will win and get your costs recovered
