BUYING FROM JAPWESTMOD CAUTION!!!!!

So I've been keeping my eye on this thread for a while now. Waiting until everything was sorted regarding my own car from JapWestMods before chiming in.

Let me just start of by saying that personally, I have had no issues with Maz up to this point as far as how helpful he has been throughout the import process. It was an extremely long wait for me, as I put my deposit down on the car on February 24th, whilst the car was still in Japan and ready to be loaded onto the boat and only today has the car been registered and I've been able to get my plates made up. A whole 145 days later! The issue here was that, on the original documents and the NOVA form, the VIN number was noted down incorrectly and so when the DVLA were doing their checks to see if the car had a valid NOVA form and checking if the fees had all been paid, nothing was coming up for my car. This was a ballache in itself but we eventually found the problem and HMRC updated their information to show the correct VIN number and the DVLA registered the car. Now I did contact Maz about this and he informed me that it was not his fault. Now I have no idea who actually notes down the information and sends it to HMRC once the car lands but surely it has to be someone at JapWestMods or someone who works closely with them? Either way, the issue got sorted and the car is now on the road.

The radiator also had a crack in it that Maz did not spot until the car was being loaded onto the transporter to be shipped to myself. However, he did throw in a standard radiator free of charge.

However, after going out for my first drive in the car tonight, as soon as I put my foot down, the clutch is slipping. It does it constantly. I tried different speeds, different road surfaces, constantly slipping as soon as I come on boost. Now there is no way that the clutch went whilst the car has been sat on my driveway for 2 months waiting for the car to be registered. Maz said that he personally picked out the car whilst he was in Japan and drove it out there for a week before dropping it off at the docks. He never informed me about the clutch situation at all. The car is obviously unsafe and unfit to drive. You can't even overtake a car on a dual carriageway without it slipping. I have just text Maz again tonight about this situation and am currently awaiting a reply.

Where does this leave me? I am certainly not going out of pocket over £500 plus labour to get a new clutch fitted to the car.
 
Seriously that’s a piss take. Ask for the whole lot back otherwise go down the moneyclaim route. Providing you put together a half decent case, you will win and get your costs recovered

I read his terms and condition , unfortunately it is quite a grey area as it states 20% restocking fee , I am not sure what the 4% was for but i am going to ask . It is a particular grey area because as you said the contract was not delivered upon . See how it goes

Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a legal right to cancel the contract between you and us within 14 days of delivery without giving a reason unless the product is a custom order/ bespoke order.

The cancellation period will end after 14 days starting the day after you or a third party acting on your behalf (excluding the company that delivers the Product to you) takes physical possession of the Product you ordered. Where you order multiple Products in one order or a Product is delivered in separate parts, lots or pieces, the cancellation period will end after 14 days starting the day after you or a third party acting on your behalf (excluding the company that delivers the Product to you) takes physical possession of the last Product, part, lot or piece that makes up your order.
If the item(s) you have ordered are damaged, faulty or incorrect, you must contact us within 14 days of receiving your item(s) to discuss your return. Please note that we can only offer a refund/replacement on items that are unused/unfitted and returned in their original packaging.

which would mean he is legally obligated to fix the isue if it is indeed the clutch slipping . You would also need to check oyour contract but i believe it should say the car was checked and may have some mild cosmtic differences .

I think this would result in either a fix of the clutch , or return refund of the car as mention in this terms of condition .

There is no someone in japwest mods , its just Maz . He has a few recption workers but no one actually making the deal and what not.

and also

"As vehicles are purchased online via our Japanese partner there may be some slight cosmetic differences between any images provided and the imported vehicle. These will be listed above and will have no significant detriment to the overall description of the vehicle."

The vehicle was delivered to me around 2 months ago, only today have I legally been able to drive the car on the road now that it is registered.

Yes i believe you have a case . It appears everyone who ever bought a car from Maz would require 2 month after it lands before actually receiving the car in hand .

I’m no lawyer but I don’t recall the consumer contracts act making any mention of bespoke/custom orders. The product is either as described and fit for purpose or it is isn’t. If it isn’t then you are entitled to a full refund. Bollocks to this restocking fee. You really should stand your ground here. These muppets are probably relying on you rolling over and accepting this. Why should you be out of pocket if they havent delivered on what they said they would. Effectively what they’ve done is hold onto your 9.2K for 6 months and change you 4 percent for the privelige. It’s not just 4 percent by the way. How much time have you wasted chasing this, wasted time on the phone, given the run around, given excuses, timeframes that aren’t adhered to. Don’t undersell yourself. If it’s a full refund you think you deserve then chase a full refund.

I have email him and will see what happens tomorrow . But you are indeed right i should receive a full refund .

Hey , unfortunately the guy went radio silence and things in my life became incredibly busy this week .i supoose the result is not the worst in the world , but i hope all future potential customers see this thread before getting scammed
 
Just file a claim online, £10K is the max for the small claims courts.

They side heavily with the consumer on matters like this, absolutely nothing to worry about.
 
Just to add my update to this situation after my last post.

Maz rang me the day after I sent him a text in regards to the clutch. We spoke on the phone for a while and he understood my frustration in the fact that the clutch was gone before I had even driven the car. He went on to say that the clutch was fine when he was driving the car in Japan and when they were pulling it on and off the transporter. I explained that the car drives fine but it's when you come on boost that the clutch starts slipping and so you wouldn't have really noticed this when just pulling it on/off the trailer. he again mentioned that he drove the car for around a week in Japan and never had any issies with the clutch but he said that his mechanic did mention that the clutch pedal seemed to sit higher than the other pedals. It actually sits lower than the other pedals and there is a good 1-2" inches of slack in the pedal before you get any pressure at all.

Long story short, he went on to say that it was a shame that the clutch was slipping and that it was really bad timing (basically saying that the clutch went the second that I put my foot down for the first time in the car...) Went on to say that they don't cover things like the clutch under their "warranty" and if they would have known that the clutch was gone before the car was delivered to me, then they would have fitted a new one for me for free labor and possibly gone 50/50 on the price of the clutch.

I carried on repeating myself and saying that there is no way that the clutch went the first time that I put my foot down in the car and that this must have been an issue that started in Japan (before I purchased the car.) We ended the phone call with him saying "let me have a word with the mechanic and see if there is anything that we can do to maybe give you some money towards the clutch or possibly get you a discount code from one of our supplies for a new clutch."

That was on the 24th July. I've sent him two texts since and not had a single reply. Kind of think that he is just trying to wash his hands of it now.

what disgusting business practice. If anything i got the fastest response when i just completely paint every picture, every post on facebook and instagram with a short summary of the shit thats going on . instant phone call

No, he was actually back in the UK by the time I had put the deposit down on the car. That was like 2/3 weeks prior.
 
He sees cars on Yahoo auctions and posts the photos from the listings on instagram as if he personally has them in stock, I wouldn't trust anything from him.
 
I bought a full sr red top conversion from them. Was advertised as full conversion loom ecu sports clutch subframe exhaust etc then also paid half for apexi power fc and controller. Got there to pick it up after 3 failed attempts and only had engine and gearbox turbo ready for collect and said the rest hadn't turned up but will be in next week and he would ship them out to me. he was being very nice and seemed a good guy and thought hey see him on monkey London videos must be a sound guy. The turbo had loads of play and clutch was standard and had it .But 2 years on still haven't got anything and just gave up trying after calls emails texts.

So anyone have a redtop loom and ecu?

Don't give up, that's how they win and carry on in business, you need to pester and pester for the parts you never received. Even threaten him with court, he can't keep getting away with it
 
Matey is right. You paid £350 for the pleasure of sweet F all and didn't even get a fondle on a steering wheel? No offence but you got mug written all over you if you sit back and happily pay 350 for the pleasure of incompetence.

Granted I can imagine you are just happy to see that wad of dosh back in your account but you sir should..... KICK OFF BIG TIME.

£350 is a skid day (cheap one)
